Public Offer Agreement

Concepts and Definitions 

  • Site visitor is an individual who comes to www.rizzle.ru  without the purpose of placing an Order.
  • User is an individual, a visitor of the Website who agrees to the terms of this Agreement and intends to place Orders in the online store https://rizzle.ru/
  • Buyer is a User who has placed an Order in the online store https://rizzle.ru/
  • rizzle.ru is an individual entrepreneur Nazarova Anastasiya Maksimovna (OGRN 319774600405196, INN 773377841415,
  • Legal address: 125480, RUSSIA, Moscow, Vilisa Latsisa street, 21, bldg. 2).
  • Seller is https://rizzle.ru/ individual entrepreneur Nazarova Anastasiya Maksimovna.
  • Online store is a website that belongs to RIZZLE located at the address https://rizzle.ru/ where Users can see the Goods and find the information on payment and delivery terms and conditions.
  • Website is https://rizzle.ru/
  • Goods are clothing, accessories and other items offered for purchase on the Site.
  • Order is a properly completed request of the Buyer to purchase and deliver Goods to the address specified by the Buyer/by means of a pickup of the Goods selected on the Site.

General Terms and Conditions

  1. The Seller sells the Goods through the online store located at https://rizzle.ru/
  2. By ordering Goods through the online store, the User agrees to the terms of sale of Goods set out below (hereinafter referred to as the Terms of Sale). In case of disagreement with this User Agreement (hereinafter referred to as the Agreement/Public Offer), the User is obliged to immediately stop using the service and leave the site  https://rizzle.ru/
  3. These Terms of Sale, as well as information about the Goods presented on the Site, are a public offer in accordance with Article 435 and paragraph 2 of Article 437 of the Civil Code of the Russian Federation.
  4. The Agreement can be changed by the Seller unilaterally without notifying the User / Buyer. 
  5. Public offer is considered to be accepted by the Site visitor / Buyer from the moment of registration of the Visitor on the Site, order placement by the Buyer without authorization on the Site, as well as from the moment of acceptance of the Buyer's order by phone specified in the “Contact” section of the Site.
  6. The retail sales agreement enters into force as soon as the Seller issues a cash or sales receipt or any other document confirming the payment.   
  7. By submitting their e-mail and phone number to the Seller, the Site visitor/User/Buyer agrees to the use of these means of communication by the Seller, as well as by third parties engaged by the Seller to perform obligations to the Website visitors/Users/Buyers, for the purpose of marketing and informational e-mails containing information about discounts, upcoming and current promotions and other activities of the Seller, on the transfer of the order for delivery, as well as other information directly related to the performance of obligations
  8. By placing the Order, the User/Buyer agrees that the Seller may assign the execution of the Agreement to a third party, while remaining responsible for its execution.
  9. All rights and obligations under the Agreement concluded with the User shall arise directly to the Seller, and the Buyer, by accepting the present Agreement, fully understands and agrees that in case of concluding the Agreement with the Seller other than RIZZLE, RIZZLE is not a party to the said Agreement and shall not bear any obligations related to its execution, except as provided by this Public Offer.
  10. As part of the Order, RIZZLE shall provide the User with information support for the Agreement concluded between the User and the Seller.
  11. You can place your order in the https://rizzle.ru/ online store 24 hours a day, 7 days a week, except during periods of maintenance work or technical failures.

Subject of the Agreement 

  1. The subject of this Agreement is to enable the User to purchase for personal, family, household and other similar needs, not related to business activities, Goods presented in the catalog of the online store at https://rizzle.ru/
  2. This Agreement applies to all types of Goods and services presented on the Site, as long as such offers with descriptions are present in the catalog of the online store.

Goods and making a purchase 

  1. In case the Goods ordered by the Buyer are out of stock, the Seller shall have the right to exclude the said Goods from the Order / cancel the Buyer's Order upon written notice to the Buyer to the e-mail specified by the Buyer during registration (or reaching out to the Buyer directly by making a phone call from the RIZZLE Call Center).
  2. In case of cancellation of fully or partially prepaid Order, the cost of the cancelled Goods is returned by the Seller to the Buyer in the manner in which the Goods were paid for. The Buyer's order is executed in accordance with the procedures specified on the Site in the section "Order Placement".
  3. The Buyer shall be fully liable for providing false or incorrect information, resulting in the inability of the Seller to properly perform its obligations to the Buyer.
  4. After placing the Order on the Site, the Seller will send the Buyer an e-mail specified by the Buyer acknowledging the details of the Order including the expected date of delivery or reach out the Buyer by phone. The manager shall specify the details of the Order, agree on the date of delivery, which depends on the availability of the ordered Goods in the warehouse and the time required for the processing and delivery of the Order.
  5. The expected date of transfer of the Order to the delivery service shall be notified to the Buyer by the manager via e-mail or by a phone call to the Buyer.

Delivery

  1. Methods and the estimated date of delivery of the Goods sold by RIZZLE are specified on the Site in the "Delivery" section. Specific delivery date may be agreed by the Buyer with the operator of the Call Center when confirming the order.
  2. The Buyer agrees that delivery may not be available for some areas.
  3. The Order is delivered to the Buyer or the third party specified in the Order as the recipient (hereinafter the Buyer and the third party are referred to as the "Recipient").
  4. The Order may be delivered to a person who can provide information about the Order (shipping number and/or Recipient's name).
  5. In order to avoid fraud, as well as to fulfill the obligations specified in Clause 5 of this Agreement, when delivering the prepaid Order, the person delivering the Order has the right to request the Recipient's identity document, as well as indicate the type and number of the document provided by the Recipient on the receipt. The Seller undertakes to guarantee the confidentiality of the personal data of the Recipient.
  6. The risk of accidental loss or accidental damage to the Goods passes to the Buyer from the moment the Order is handed over and the Buyer signs the documents confirming the delivery of the Order. In case of non-delivery of the Order, the Seller shall refund the Buyer the cost of the prepaid Order and the delivery after receiving the confirmation of the loss of the Order from the delivery service.
  7. The cost of delivery of each Order is calculated individually, based on its weight, region and method of delivery, and (if necessary) method of payment. The cost of delivery is specified on the Site at checkout or you can contact RIZZLE call-center for further information about the cost of delivery.
  8. The Seller's obligation to deliver the goods to the Buyer is considered to be fulfilled from the moment when the courier delivers the Goods to the Recipient or the Recipient receives the Goods at the post office or at the pre-agreed place of delivery.
  9. Upon receipt of the Order in the office of the transportation provider, after payment for the delivered Goods the Recipient shall have the right to conduct the quality check of the delivered Goods and open them in the presence of the transportation provider employees to ensure the Goods are in the declared quantity, assortment and completeness. In case of any claims (underdelivery, delivery contains the wrong items, manufacturing defects, and other faults), Nonconformity Statement shall be made by the employees of the transportation provider.
  10. In case of return of the faulty Goods delivered by the transportation provider, the returned Goods shall be accompanied by the following documentation from the Recipient:
    • letter to request a refund for  faulty Goods;
    • copy of Nonconformity Statement;
    • copy of payment receipt;
    • copy of inventory list;
    • return form.
  11. When accepting the Order from the courier, the Recipient shall have the right to conduct the quality check of the delivered Goods to ensure the Goods are in the declared quantity, assortment and completeness. If there are no claims to the delivered Goods, the Recipient signs Proof of Delivery Form or other similar document provided by the courier, and pays for the Order (in the absence of 100 % prepayment).
  12. The signature on the documents proves that the Recipient has no complaints about the Goods and that the Seller has fully and properly fulfilled its obligation to transfer the Goods.

Payment

  1. The price of the product sold in the online store is indicated in rubles of the Russian Federation (RUB) and/or in US dollars (USD). 
  2. The price of the Goods is indicated on the website. If the price of the ordered Goods is incorrect, the Seller informs the Buyer about this in order to confirm the order at the corrected price or cancel the order. If it is impossible to contact the Buyer, this order is considered to be canceled. If the order was paid, the Seller returns the money to the Buyer and the money will be automatically applied to your card or original method of payment 
  3. The Buer has the right, at its discretion, to unilaterally change the price of the Goods on the Site. However, if the Goods have already been ordered by the Buyer, the price shall not be changed.
  4. Things to be aware of by paying with cards: 
    • In accordance with the regulation of the Central Bank of the Russian Federation "On issue of bank cards and on transactions made using payment cards" dated 24.12.2004 No. 266-P, bank card transactions are made by the cardholder or an authorized person.
    • Bank card transactions are authorized by the bank. If the bank has reason to believe that the transaction is fraudulent, the bank has the right to refuse to perform this operation. Fraudulent transactions with bank cards fall under Article 159 of the criminal code of the Russian Federation.
    • In order to avoid many forms of bank cards misuse when paying, all Orders placed on the Site and prepaid by bank card are checked by the Seller. In order to verify the identity of the owner and their eligibility to use the card, the Seller has the right to ask for the copy of Buyer’s identity document.
  5. RIZZLE has the right to provide discounts on products and offer a bonus program. The types of discounts, bonuses, the procedure and conditions for bonus points accrual are determined by the Sellers and can be changed unilaterally.
  6. In case marketing activities mean sending additional marketing gifts to the Buyer with the Order, delivery of said gifts shall be at Buyer's expense. In order to refuse the gift, the Buyer should contact the Customer Service.
  7. An Order is considered incomplete if the Buyer has informed about the change in the decision before the order is assembled in the store. If the Buyer informs the Seller about this after the order has been assembled in the store, the order is considered rejected.

The specified provisions are not a manifestation of discrimination and are not intended to infringe the rights guaranteed by the legislation of the Russian Federation to consumers, but are aimed at reducing the losses of RIZZLE from the actions of Customers.

Returns and Refunds 

The return of Goods sold by RIZZLE shall be subject to the conditions specified in Return Policy page of the Site.

Responsibilities

  1. The Seller is not liable for any damage caused to the Buyer as a result of improper use of the Goods purchased in the online store.
  2. The Seller is not responsible for the content and operation of external sites.

Confidentiality and Data Protection Policy

  1. Personal data of the User/Buyer is processed in accordance with the Federal Law "On Personal Data" No. 152-ФЗ.
  2. The User provides the following information at registration: Surname, Name, contact phone number, e-mail address, delivery address.
  3. By providing their personal data to the Seller, the Site Visitor/User/Buyer agrees to processing their personal data by the Seller, including for the purpose of fulfilling the obligations to the Site Visitor/User/Buyer under this Public Offer, the Seller's promotion of products and services, electronic and SMS surveying, monitoring the results of marketing campaigns, customer support, the organization of delivery of goods to customers, consumer credit from a partner company of the Seller, prize giveaways to Site Visitors/Users/Buyers, monitoring Site Visitors/Users/Buyers satisfaction and the quality of services provided by the Seller.
  4. Processing of personal data means any action (operation) or a set of actions (operations) performed with or without the use of automated means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change) extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the need for it arose in the performance of obligations), depersonalization, blocking, deleting, destruction of personal data.
    • The Seller shall have the right to send information, including advertising messages, to the User/Buyer's e-mail and cell phone with their consent expressed through actions unambiguously identifying this subscriber and allowing to reliably establish their will to receive the message. The User/Buyer may refuse to receive advertising and other information without explaining the reasons for such refusal by informing RIZZLE of their refusal by sending an appropriate application to the Seller's e-mail address: rizzle.store@mail.ru. Service messages informing the User/Buyer about the order and the stages of its processing are sent automatically and may not be rejected by the User/Buyer.
    • The data subject shall have the right to withdraw his or her consent by sending an e-mail to the Seller: rizzle.store@mail.ru.
  5. The Seller may use cookie technology. "Cookies" do not contain confidential information. Visitor / User / Buyer hereby gives his or her consent to the collection, analysis and use of cookies, including by third parties for the purposes of statistical and optimization of advertising messages.
  6. The Seller receives information about the ip-address of the visitor of the Site https://rizzle.ru/. This information is not used to identify the visitor.
  7. The Seller is not responsible for the information provided by the User/Buyer on the Site in a publicly available form.
  8. The Seller has the right to record telephone conversations with the User/Buyer. In this case, the Seller undertakes to prevent attempts of unauthorized access to information received during telephone conversations, and/or its transfer to the third parties which are not directly related to execution of Orders, according to paragraph 4  Article 16 of the Federal Law "On information, information technologies and information protection".

Public Offer Validity 

This Public offer shall be effective from the moment of its acceptance by the Site Visitor/Buyer, and is valid until the withdrawal of the acceptance of the Public offer.

Additional Terms and Conditions

  1. The Seller may assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer to third parties.
  2. The online store and services provided by the Site may be temporarily partially or completely unavailable due to preventive or other maintenance works or for any other technical reasons. Technical service has the right to carry out necessary preventive or other works from time to time with or without prior notification of Buyers.
  3. The relationship between the User/Buyer and the Seller is governed by Russian law.
  4. If the User/Buyer has any questions or claims, he/she is entitled to contact the Seller by phone or by any other available means.
  5. Should any provision of this Agreement is held by a court to be invalid, invalidity shall not affect the remaining provisions.

Public Offer Validity
